1 About these Terms
Attune is owned and run by HeyAttune, Inc., a Delaware corporation based in Massachusetts, USA ("Attune", "we", "us"). On the App Store, our founder Vincent Zheng is currently listed as the seller, and he provides the app on behalf of HeyAttune, Inc.
By creating an account or using Attune, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you don't agree, don't use Attune.
2 Who can use Attune
- You must be at least 13 years old, or older if the law where you live requires it to use Attune on your own.
- If you're under 18, or under the age of majority where you live, you need permission from a parent or guardian, who agrees to these Terms for you.
- You can't use Attune if the law forbids it, including US sanctions laws.
3 Your account
- You need an account to use Attune. Use an email address that's yours and keep it secure: anyone who can open your email can sign in to your account.
- One account per person. Don't share, sell or transfer your account, or create accounts for other people or with automated tools.
- You're responsible for what happens on your account. Tell us at heyattune@gmail.com if you think someone else is using it.
- Choose a username that isn't offensive or misleading and doesn't use someone else's name or brand. We may change or take back a username that breaks these Terms.
- You can delete your account at any time in the app: Profile, then Delete Account. This doesn't cancel a subscription.
4 Using Attune
We give you a personal, non-commercial, non-exclusive, non-transferable license to use the Attune app on devices you own or control, under these Terms. We can end it if you break them. You agree not to:
- copy, scrape or bulk download songs, results or other data from Attune, or access it with bots or other automated tools
- use Attune or its results to build a competing product or dataset, or to train AI models
- reverse engineer the app or our servers, or get around limits, payments or security
- overload, disrupt or attack Attune, or try to make our AI behave in ways it shouldn't
- harass, bully, threaten or impersonate anyone
- post anything illegal, hateful, sexual, violent or misleading, anything that infringes someone else's rights, or anyone's private information
- sell, rent or commercially use Attune or its results without our written permission
- break the law, or help anyone else break these rules
5 Your content
"Your content" means things you add to Attune, like your username, profile photo, Song of the Day picks and journal entries.
- You own it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, adapt (for example, to resize a photo), display and share your content to run, improve and promote Attune. The license ends when you delete the content or your account, except for copies in backups for a limited time. We won't use your name or photo in advertising without asking you first.
- You have the rights. Only post content you own or have permission to use.
- We can remove it. We may remove content or limit accounts that break these Terms. We don't review everything that's posted, and we aren't responsible for content other users post.
- Reporting. To report a user or content that breaks these Terms, email heyattune@gmail.com with their username. We review reports promptly, usually within 24 hours, and remove content and accounts that break these Terms.
- Feedback. If you send us ideas or suggestions, we may use them freely, without paying or crediting you.
6 Music, AI and other services
- Music. Attune helps you find songs. It doesn't sell or host full songs. Previews, artwork and song details come from Apple and other music services and belong to their owners. Previews are for personal listening inside Attune.
- Suggestions. Attune picks songs by comparing how they sound and, in some features, with AI. Suggestions, the reasons shown with them, genre labels and other music facts can be wrong or incomplete, and some songs have explicit lyrics. Use them to discover music, not as facts to rely on.
- Apple Music and Spotify. If you connect them, you let Attune act in those services for you, only as you direct, for example to create a playlist. Their own terms apply, and you can disconnect at any time.
- Other services. Attune isn't affiliated with or endorsed by Apple, Spotify, or any artist or label. We aren't responsible for other services or websites you reach through Attune.
7 Free features, Premium and packs
Free features
Attune is free to use, with a daily number of free searches and Discover swipes shown in the app. We may change the free amounts and which features are free.
Attune Premium
Premium is a monthly subscription that renews automatically. It includes unlimited Song, Mood and Playlist searches, unlimited Discover swipes, and any other benefits shown in the app when you subscribe.

"Unlimited" means unlimited for normal personal use. To protect Attune, we may limit use that looks automated or abusive.
Search packs and swipe packs
Packs are one-time purchases that add searches or swipes to your account, and they don't renew. Unused credits have no cash value, can't be transferred or exchanged, and don't expire while your account is open. They end if you delete your account, if we close it for breaking these Terms, or if we stop offering Attune, except where the law requires a refund.
Refunds
Purchases are made through Apple, or Google Play if you use Android, which handles refunds under its own policies. For Apple, go to reportaproblem.apple.com. We can't issue refunds ourselves. Except where the law or the store's policies say otherwise, purchases are final and partial subscription periods aren't refunded.
8 Our rights
The Attune app, website, design, code, our song-matching technology, and the Attune name and logo belong to HeyAttune, Inc. and our licensors, and are protected by law. These Terms don't give you any rights to them beyond the license in section 4.
9 Copyright complaints
If you believe something on Attune infringes your copyright, email heyattune@gmail.com with:
- your name and contact details
- the work you believe is being infringed
- where it appears on Attune, for example a username
- a statement that you believe in good faith the use isn't authorized
- a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or may act for the owner
- your physical or electronic signature
We remove infringing content and close the accounts of repeat infringers.
10 Ending or changing Attune
- You can stop using Attune and delete your account at any time.
- We may suspend or close your account, or remove content, if you break these Terms, if the law requires it, or to protect Attune, our users or others. Where it's reasonable, we'll tell you why.
- We may change, add or remove features, or stop offering Attune. If we stop offering Attune entirely, we'll try to tell you in advance.
- Parts of these Terms that by their nature should continue, like ownership, disclaimers, limits on liability, indemnity and how disputes are resolved, still apply after your account ends.
11 Changes to these Terms
We may update these Terms. We'll post the new version here and change the date at the top. If a change is significant, we'll tell you in the app or by email before it takes effect. If you keep using Attune after a change takes effect, you accept the new Terms. If you don't agree, stop using Attune and delete your account. A change to section 15 won't apply to a dispute you've already told us about.
12 Disclaimers
13 Limitation of liability
Nothing in these Terms limits liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by our negligence. If you live in the EU or UK, you keep the rights your local consumer laws give you.
14 Indemnity
To the extent the law allows, you'll defend, indemnify and hold harmless HeyAttune, Inc. and its officers, directors, employees and agents against any claims, losses and costs, including reasonable legal fees, that come from your content, your misuse of Attune, or your breaking these Terms or the law.
15 Disputes and arbitration
Talk to us first
Before making a claim, email heyattune@gmail.com with your name, your account email, what happened and what you're asking for. We'll try to resolve it with you within 60 days. We'll do the same before making a claim against you.
Arbitration
If we can't resolve it, you and HeyAttune, Inc. agree that any dispute about Attune or these Terms, including whether this section applies, will be settled by binding individual arbitration rather than in court. The American Arbitration Association (AAA) will run it under its Consumer Arbitration Rules, with one arbitrator. Hearings can be held by video or phone, or in person in the county where you live. Fees are paid as the AAA rules say, and those rules limit what consumers pay. The arbitrator can award the same individual relief a court could, but only for you. The Federal Arbitration Act governs this section.
Exceptions
Either of us can take an individual claim to small claims court if it qualifies. Either of us can also go to court to stop someone from misusing intellectual property.
No class actions or jury trials
You and we may bring claims only as individuals, not as a plaintiff or class member in any class, collective, consolidated or representative action, and the arbitrator can't combine the claims of more than one person. You and we both give up the right to a jury trial.
Mass filings
If 25 or more similar claims are filed against us by, or with the help of, the same or coordinated lawyers, the AAA's rules for multiple or mass filings apply and the claims may be handled in batches.
Opting out
You can opt out of this arbitration agreement within 30 days of first agreeing to these Terms. Email heyattune@gmail.com from your account email with the subject "Arbitration opt-out", and include your name and username. Opting out doesn't affect the rest of these Terms.
If part of this section doesn't hold
If the ban on class actions is found unenforceable for a claim, that claim goes to court instead of arbitration. If any other part of this section is found unenforceable, the rest still applies.
Outside the US
If you live in the EU, the UK or another country whose law doesn't allow this section, it doesn't apply to you, and you can bring claims in the courts where you live.
16 Governing law and courts
Massachusetts law governs these Terms, without regard to its conflict of law rules, and the Federal Arbitration Act governs section 15. Claims that aren't arbitrated will be heard in the state or federal courts in Massachusetts, and you and we agree to those courts' jurisdiction. If you live outside the US, you keep the protections of your local consumer laws and may bring claims in your local courts.
17 Apple App Store terms
If you got Attune from Apple's App Store:
- These Terms are between you and HeyAttune, Inc., not Apple. Apple isn't responsible for Attune or its content.
- Your license covers Apple-branded devices you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow, including use by family members through Family Sharing.
- Apple has no obligation to provide maintenance or support for Attune.
- If Attune doesn't meet a warranty that applies to it, you can tell Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for Attune, and any other claims, losses or costs from a failure to meet a warranty are our responsibility, to the extent these Terms don't disclaim them.
- We, not Apple, are responsible for handling any claims about Attune, including product liability claims, claims that Attune fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If anyone claims that Attune, or your use of it, infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and resolving the claim.
- You confirm that you're not in a country under a US Government embargo or designated as "terrorist supporting", and that you're not on any US Government list of prohibited or restricted parties.
- You must follow any third-party terms that apply when you use Attune, like your mobile carrier's.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Apple's Licensed Application End User License Agreement also applies to the app. These Terms add to it.

18 General
- These Terms, the Privacy Policy and any terms shown with a feature or purchase are the whole agreement between you and us about Attune.
- You can't transfer these Terms to anyone else. We can transfer them, for example as part of a merger, acquisition or sale of assets.
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we don't enforce part of these Terms right away, we can still enforce it later.
- Neither of us is responsible for delays or failures caused by events beyond reasonable control, like outages at our providers, natural disasters or war.
- We can send you notices by email or in the app. You can reach us at heyattune@gmail.com.
- These Terms are written in English. If a translation conflicts with the English version, the English version controls.
